Legal terms
Terms & Conditions
These Terms apply when you use tickedbucketlist.com, its free tools and resources, the Trip Fit Check & Starter Kit, Trip Decision Review, forms, support routes and other products or services supplied under the Ticked Bucket List brand.
Key points
- Ticked Bucket List is operated by Pain Strategies. Pain Strategies is the contracting party for paid products and services unless your order documents state otherwise.
- Ticked Bucket List provides non-urgent travel-planning support. It does not provide medical care, travel booking, insurance advice, legal advice, official approval or guarantees.
- The Starter Kit is a one-time digital purchase, not a subscription. Account access and trip answers stored in your browser are separate.
- Trip Decision Review is a separate written service for one accepted, developed trip. You apply before payment, and its service particulars form part of your agreement.
- Product-page, checkout, invoice and service-specific terms may add details to these general Terms. Mandatory consumer rights still apply.
Use appropriate urgent or emergency services. Ticked Bucket List cannot assess symptoms, medical urgency or whether travel is medically safe.
1. Agreement and operator
Ticked Bucket List is operated by Pain Strategies. In these Terms, “Ticked Bucket List”, “we”, “us” and “our” mean Pain Strategies when it operates the website or supplies a product or service under the Ticked Bucket List brand.
By accessing or using the website, a tool, resource, account, paid product, form, support route or service, you agree to these Terms and the documents that apply to that use.
Those documents may include the Privacy Policy, Safety & Boundaries, Medical & Travel Disclaimer, a product page, checkout terms, order confirmation, invoice, accepted service particulars or another notice shown before you submit or pay.
Transaction-specific terms may add or clarify commercial details for that purchase or service. If they conflict with these general Terms, the transaction-specific terms control that transaction to the extent of the conflict, subject to rights and obligations that cannot lawfully be changed.
If you do not agree to the applicable terms, do not use the relevant product, tool or service.
2. Services and boundaries
What Ticked Bucket List may provide
Ticked Bucket List may provide free and paid travel-planning resources, including:
- the Free Mini-Check;
- Destination Fit Guides and other planning resources;
- interactive tools, checklists and downloadable materials;
- the Trip Fit Check & Starter Kit;
- Trip Decision Review;
- contact, account, purchase, application, intake and support routes.
We may add, rename, update, limit or remove products and features. Changes do not alter a completed purchase or accepted service agreement unless its terms, applicable law or an operational necessity allow the change.
Planning support only
Ticked Bucket List does not provide medical advice, diagnosis, treatment, prescribing, medication changes, medical monitoring, medical clearance, urgent care or emergency care.
It is not a travel agency, tour operator, insurer, law firm, embassy, regulator, airline, accessibility certifier or booking service. It does not make bookings, provide official permission or guarantee safety, accessibility, symptom control, insurance cover, provider performance or travel outcomes.
Using Ticked Bucket List does not create a doctor-patient, clinician-patient, travel-agent, insurer, fiduciary or lawyer-client relationship.
Use the person, provider or official authority that controls a medical, emergency, insurance, legal, visa, airline, booking or accessibility decision.
3. Eligibility, accounts and local storage
Age and legal capacity
You must be at least 18 years old and legally able to enter a contract to buy a paid product or enter a Trip Decision Review agreement.
A younger person may use public information or a free tool with appropriate parent or guardian involvement where permitted by applicable law. A parent or guardian is responsible for deciding whether that use is appropriate.
Accounts and access details
- Provide accurate account, order and contact information.
- Keep login details, access links and devices reasonably secure.
- Do not use another person’s account without permission.
- Tell us promptly if you believe an account or paid-access route has been used without permission.
Browser storage
Some tools store answers or progress in the browser on the device you use. This is different from customer-account access.
- Clearing browser data may delete saved answers.
- Changing browser or device may not move saved answers.
- Use an available export or backup option before changing device.
- You are responsible for files you download, copy, email, print or share.
4. Starter Kit and other paid digital products
The Trip Fit Check & Starter Kit is a self-guided, browser-based digital product. It is a one-time purchase, not a subscription, unless a future product page clearly states otherwise.
- The purchaser receives account-based access to the current Starter Kit under the conditions shown at purchase.
- The purchaser may use it again for their own future trips, subject to these Terms and any product-specific licence.
- Trip answers normally remain in the browser on the device used unless the user exports or otherwise saves them.
- No person reviews the user’s Starter Kit answers, and the Starter Kit is not an individual service.
- Access, browser compatibility, included features and support are described on the product page and at checkout.
Paid digital products are licensed for the purchaser’s personal, non-commercial use. Purchase does not transfer ownership of the product, website, templates, method, design or underlying intellectual property.
Read the current Trip Fit Check & Starter Kit page before purchase.
5. Trip Decision Review
Trip Decision Review is a separate written planning service for one accepted trip that is already developed enough to review. It is not included with the Starter Kit.
- You apply before payment.
- We decide whether the proposed trip and decision are within the published service scope.
- An invoice or payment request is issued only after the trip is accepted.
- The service covers one accepted trip and one main planning decision.
- The review is written and asynchronous. There is no default live consultation or call.
- Delivery timing begins only after payment and after we confirm that the required intake is complete.
- The service ends after delivery and the limited written follow-up described in the accepted service terms.
The accepted service particulars, invoice and applicable Trip Decision Review terms form part of your agreement. They control the accepted trip, main decision, scope, price, timing, information required, delivery and follow-up.
We may decline, redirect, pause or close a request that is outside scope, unsafe, incomplete, abusive, legally risky, materially different from the accepted trip or not suitable for the service.
Read the current Trip Decision Review page before applying.
6. Orders, payments, refunds and access
Prices, currency and payment
- The price and currency shown on the applicable product page, checkout, invoice or payment request apply to that transaction.
- Paid products and services are supplied by Pain Strategies under the Ticked Bucket List brand. A payment confirmation or statement may display Pain Strategies.
- Payments are handled by approved third-party payment processors. We do not receive your full payment-card number.
- You are responsible for any bank, currency-conversion or payment-provider charges that are not included in the displayed price.
- Taxes will be handled as required by the transaction terms and applicable law.
When an order or service is accepted
A website submission, application or unpaid invoice is not necessarily an accepted order. Acceptance occurs when we issue the relevant order confirmation, provide paid access or confirm an accepted service and receive payment, as applicable.
Starter Kit and digital-product refunds
Refund eligibility depends on the purchase conditions shown before payment, whether digital access has been provided or used, the reason for the request and any mandatory consumer rights.
A change of mind after digital access has been supplied does not create an automatic refund unless the purchase conditions or applicable law provide one. Access failures, duplicate payments or an incorrect charge will be reviewed separately.
Trip Decision Review cancellations and refunds
- Before payment, there is no charge.
- After payment but before review work begins, the working policy is a full refund, less unavoidable processor fees only where lawful and clearly disclosed.
- After review work begins, there is no change-of-mind refund under the working policy, subject to rights that cannot be excluded.
- If we cannot deliver the accepted service, we will correct the failure or refund the affected service as required by the accepted terms and applicable law.
- A material change to the trip or main decision may require the work to pause, be re-scoped or close. One service does not automatically cover a replacement trip or a new main decision.
Access and payment problems
Contact info@tickedbucketlist.com with the purchase email, date, amount and transaction reference. Do not send full payment-card information.
Nothing in this section removes mandatory consumer rights or prevents you from using a complaint or remedy available under applicable law.
7. Information, privacy and user responsibilities
Information you provide
You are responsible for ensuring that information you submit is accurate, relevant, current and yours to provide.
Do not send unnecessary medical records, clinical letters, test results, prescriptions, medication lists, passport or identity documents, banking details, insurance files, legal files or unrelated information about another person through general forms, email or Trip Decision Review intake.
You keep ownership of your personal content. You give us permission to process it only as reasonably needed to operate the website, respond, assess scope, deliver a requested product or service, maintain transaction and support records, protect the service and meet legal obligations, as explained in the Privacy Policy.
Your planning responsibilities
You remain responsible for:
- medical, medication and fitness-to-travel decisions;
- insurance cover, exclusions, claims and assistance routes;
- passports, visas, transit, entry rules and local laws;
- bookings, cancellations, refunds and provider contracts;
- airline, airport, accommodation and accessibility arrangements;
- deciding whether an itinerary, activity, pace or environment is appropriate for your circumstances;
- confirming important facts with the responsible provider or official source before relying on them.
8. Responsible use and intellectual property
Acceptable use
You must not:
- use the website or products for unlawful, harmful or fraudulent purposes;
- bypass payment, access, account, safety or technical controls;
- interfere with, overload, probe, security-test or automate access without written permission;
- submit false, abusive, misleading, infringing or irrelevant content;
- present a Ticked Bucket List output as medical, legal, insurance, official or provider-approved advice;
- use another person’s account, purchase or service without permission.
Intellectual property and personal licence
Pain Strategies owns or licenses the Ticked Bucket List website, branding, text, tools, design, planning methods, templates, guides, downloads and other materials.
You may use materials supplied to you for your own personal, non-commercial travel planning, subject to the applicable product licence. You may not copy, resell, republish, redistribute, scrape, remove notices, create a competing commercial product from, or use the materials to train or evaluate a system without written permission.
Feedback or suggestions may be used to improve Ticked Bucket List without payment or obligation, but we will not publish your personal story, name or testimonial without appropriate permission.
9. Third parties, availability and changing information
Third-party services
The website may use or link to payment processors, Squarespace, account tools, forms, email services, analytics, maps, social platforms, travel providers, official sources and other third parties.
A third party controls its own service, terms, privacy practices, availability, prices, policies and decisions. A link or reference does not mean that we guarantee or certify the third party.
Travel and accessibility information changes
Travel information can change, including schedules, weather, closures, strikes, entry requirements, health rules, airline procedures, accessibility details, prices and local conditions.
Content, tools and outputs may contain incomplete, outdated or incorrect information. Verify a material fact with the provider or official source that controls it before booking, paying, travelling or relying on it.
Availability and changes
We may maintain, update, suspend, limit or discontinue a page, tool or feature. We do not guarantee uninterrupted, error-free or permanent availability.
Where a change materially affects an existing paid entitlement or accepted service, we will apply the applicable purchase terms, service-specific terms and mandatory rights.
10. Disclaimers, liability, disputes and contact
Disclaimers
To the fullest extent permitted by law, the website, free tools, resources, paid digital products and services are provided “as is” and “as available”. We do not promise that they will be uninterrupted, complete, current, error-free, suitable for a particular purpose or capable of producing a particular travel or health outcome.
Nothing in these Terms excludes a warranty, right, remedy or liability that cannot lawfully be excluded or limited.
Limitation of liability
To the fullest extent permitted by law, Pain Strategies, Ticked Bucket List and their founders, personnel, contractors and service providers are not liable for indirect, incidental, consequential, special, punitive or similar loss arising from use of, inability to use or reliance on the website, a tool, content, product, service or third-party information.
This may include, where the law permits, loss connected with bookings, cancellation, provider failure, missed travel, accessibility problems, insurance or entry decisions, data loss, lost opportunity or business loss.
To the fullest extent permitted by law, the total aggregate liability for a claim arising from a paid product or service will not exceed the amount paid to Pain Strategies for the product or service giving rise to that claim.
Suspension or termination
We may suspend, restrict or end access where reasonably necessary because of breach, misuse, non-payment, fraud, security risk, abusive conduct, legal obligation, an unsafe or out-of-scope request, or a material failure to provide required information.
Suspension or termination does not remove rights, payment obligations or provisions that by their nature continue after access ends.
Governing law and disputes
These Terms are governed by the laws of the Republic of Kenya, unless mandatory law applicable to you requires otherwise.
Courts with jurisdiction in Nairobi, Kenya will have jurisdiction over disputes, unless applicable law gives you a right to bring a claim elsewhere or provides another mandatory process.
Before starting formal proceedings, you may contact us so the issue can be reviewed. This does not limit a right to use a regulator, court, chargeback, complaint or consumer remedy available under applicable law.
General contract terms
- If one provision is invalid or unenforceable, the remaining provisions continue to apply.
- A delay in enforcing a right is not a waiver of that right.
- You may not transfer a paid account, licence or service agreement without written permission. We may transfer our rights and obligations as part of a lawful business restructuring or transfer.
- We are not responsible for delay caused by events outside our reasonable control, but this does not remove obligations that cannot be excluded.
- Electronic notices, order confirmations, invoices and accepted service documents may form part of the agreement.
Changes to these Terms
We may update these Terms when products, operations, technology or law changes. The effective date and version at the top of the page will be updated. Where required, material changes affecting an existing paid agreement will be communicated or handled under that agreement and applicable law.
